Terms and conditions of sale
These general terms and conditions of business apply to all purchases of products or services made on the website of Batiplus AG, www.batiplus.ch, via the online shop (hereinafter referred to as the Site). The masculine form "customer" used hereafter naturally refers to both customers and clients. Specific conditions for the purchase of certain products or services are set out below.
The online offers of products and services are only valid as long as they are visible on the Site and within the limits of available stocks. The images appearing on the Site are for illustrative purposes only and do not form part of the contractual conditions. The information contained in the catalogues and explanatory notes is given for information purposes only and does not constitute a contractual document.
Batiplus accepts no responsibility for any errors or omissions in the drawings, images or diagrams, or in the said catalogues or notices.
The prices indicated on the Site are in Swiss francs only. They are inclusive of all taxes (VAT) and include the advance recycling tax (ART). However, they do not include a contribution to the processing and shipping costs, which will be invoiced separately. All orders are payable exclusively in Swiss francs. Batiplus reserves the right to change its prices at any time, but the prices charged to the customer for the products delivered are those in effect at the time of the order and which appear on the order confirmation. In addition, promotional discounts offered in the context of commercial actions on the Site are deducted directly from the amount of the order.
Conclusion of the contract
The products and prices published in the online shop constitute an offer. However, this offer is always subject to the (resolutive) condition that delivery is possible or that the price indicated (by the manufacturer or by Batiplus) is free of error.
The contract is concluded as soon as the customer places an order with Batiplus. The receipt of the order is confirmed to the customer by an automatically generated e-mail sent to the address provided by the customer. The automatically generated order confirmation e-mail does not constitute a guarantee of availability or delivery. It only indicates to the customer that Batiplus has received the order and that the contract has been concluded, provided that delivery is possible.
An order only becomes final after acceptance by Batiplus. The sending of the order by the customer implies his acceptance of these general terms and conditions of sale in their entirety, to the exclusion of any other terms or conditions. The terms and conditions governing the sale in the Batiplus Showroom are not applicable to orders placed on the Website. Batiplus reserves the right to refuse any customer's order.
The price charged is the price indicated on the order confirmation sent to the customer. Unless otherwise agreed, all products and services* are payable by: EuroCard/MasterCard, Visa, American Express, Diners, Postcard, Postfinance, Paypal, Twint and invoice.
All payment transactions take place in a secure area on the Datatrans platform. The data recorded by Batiplus & Datatrans constitute proof of all transactions between Batiplus and its customers. The data recorded by the payment system constitutes proof of the financial transactions. The credit card used for payment is debited at the time of the order.
The delivery times indicated on all order confirmations are indicative and apply from the moment the order confirmation is sent. Upon receipt of confirmation from our suppliers, the expected dates of arrival at our premises will be confirmed, which may or may not include additional lead times related to services agreed upon at the time of the order by Batiplus. Any claim for cancellation of the order and/or compensation for any kind of delay in delivery by the suppliers and/or Batiplus is excluded.
Payment method "Advance payment on invoice"
The payment method "Purchase on account" is exclusively intended for private individuals of legal age who are domiciled in Switzerland. The invoice issued with the payment method "purchase on invoice" is payable without deduction within 10 days of its issue date. No goods will be sent until the invoice has been paid.
If the invoice is not paid within 10 days, the order shall be considered cancelled.
IN THE CASE OF "PURCHASE ON ACCOUNT" PAYMENT METHODS, BATIPLUS WILL CARRY OUT CREDIT CHECKS.
Exchanges, returns, warranty cases and complains
The customer shall send complaints about defective goods and/or services and returns directly to Batiplus by email (firstname.lastname@example.org) and shall settle the details of the procedure with Batiplus. The existence of such disputes does not release the customer from his obligation to pay the invoice or the total value of the dispute. In the case of returns of goods purchased by "EuroCard/MasterCard, Visa, American Express, Diners, Postcard, Postfinance, Paypal", the refund or cancellation will be made to the credit card or Paypal account indicated by the customer and made out in his name, provided that the customer has paid the original invoice in full. In the case of returns of goods purchased by "Purchase on account", the refund will be made to the bank or post office account indicated by the customer and made out in his/her name, provided that the customer has paid the original invoice in full.
It is the customer's responsibility to check the goods immediately upon delivery and to make any reservations and complaints regarding possible defects or non-conformities. In general, items returned incomplete, damaged or soiled by the customer will not be accepted. In the case of a return of goods, the shipping costs are to be paid by the customer.
Orders placed on the Site are generally sent by post. Batiplus offers the customer postal delivery for orders of CHF 100.00 or more. Below CHF 100.00 the cost of preparing and sending the goods is CHF 18.00. This amount is indicated in your shopping cart at the time of payment.
If the article is not sent by post due to its size or weight, the amount of the delivery will be automatically calculated by the system according to the type of goods ordered and the delivery location. This service is usually provided by our logistics team.
If the order consists of several items and the delivery times are different, Batiplus will send the order in one go when it is complete.
If the order contains one or more bulky items, Batiplus reserves the right to adjust the delivery costs. Batiplus will then contact the customer to inform him/her of the delivery costs applicable to his/her order.
On request, it is also possible to personalise the delivery of an order.

As in the Batiplus showroom, in the event of dissatisfaction, it is possible to return and exchange the goods upon presentation of the proof of payment. The goods must be returned in their original packaging, unused, clean, complete and undamaged. Items that have been damaged or soiled by the customer cannot be returned.
It is the customer's responsibility to check the goods immediately upon receipt and to report any defects or differences from the order. The statutory provisions governing complaints (Art. 201 CO) apply.
Returns are possible within 14 calendar days of receipt. If the customer is unable to provide confirmation of receipt, the 14-day period is counted from the date of dispatch of the order.
Only items in their original, unused, clean, complete and undamaged packaging, together with the return form, will be returned. In the case of a return of goods, the shipping costs are to be paid by the customer, who also bears the shipping risk. The goods can be sent back by post or returned free of charge to the Batiplus showroom. If the goods are returned by post, they must be sent to the following address:

In the case of a free return of goods to the Batiplus showroom, the goods must be brought in together with the return form. Refunds can only be made by the same means of payment as the original payment. Therefore, no cash refunds will be made on site. After receipt of the goods, Batiplus AG will check whether the goods are in good condition and, if necessary, decide on a refund. This refund is made by the same means of payment as the original payment, usually within 5 working days. Only the value of the goods is refunded. Any shipping costs will not be refunded.
Exclusion of the right of return
All articles covered with fabric/leather, made of wood species or ordered specially for the customer cannot be returned or exchanged. In addition, special finishes cannot be returned or exchanged.
Conditions of exchange
After receipt of the ordered items, the goods can only be exchanged at the Batiplus showroom in Puidoux or by returning them by post. Unused, clean, undamaged items in their original packaging can be exchanged. Items must be accompanied by the delivery note or a return form issued by Batiplus.
Exchanges are possible within 14 calendar days of receipt. If the customer is unable to provide confirmation of receipt, the 14-day period is counted from the date the order was sent.

All articles covered with fabric/leather, made of wood species or ordered specially for the customer cannot be returned or exchanged. Furthermore, special finishes cannot be returned or exchanged.
In case of delivery of defective goods, the procedure is the same as for returns. The customer must inform Batiplus AG. Warranty cases are handled in the Batiplus showroom. The delivery note and the goods in their original packaging must be presented. The invoice with the product description serves as a warranty certificate. Exchange under warranty or repairs under warranty do not result in any extension of the original warranty period.
Any total or partial non-performance by the client of any of his obligations, as well as the non-observance of any payment due date, may lead, at Batiplus' discretion, either to the immediate payment of the sums still due on any grounds whatsoever, and to the suspension of all deliveries, or to the cancellation of the contracts in progress.
