1. Person responsible and content of the data protection policy
In this data protection declaration, we, Batiplus SA, explain how we collect and process personal data.
The term'personal data' or'data' refers to any information relating to a specific or identifiable individual.
If you provide us with the personal data of other people (for example, members of your family or work colleagues), please ensure that these people are aware of this data protection declaration and only share their data with us if you are authorised to do so and if this personal data is correct.
Please note that other data protection rules or general terms and conditions, conditions of participation and similar documents may govern data protection in relation to specific subjects.
In this document, the terms used to designate persons or functions are taken in a generic sense; they have both feminine and masculine meanings.
Please consult the information below for details of the personal data we collect from you and the purposes for which it is used. In matters of data protection, we are guided primarily by the requirements of Swiss data protection law, in particular the Federal Data Protection Act (DPA) and the EU's General Data Protection Regulation (GDPR), the provisions of which may apply in individual cases.
Please bear in mind that the information below will be reviewed and amended from time to time. We therefore recommend that you consult this data protection policy regularly. The applicable data protection provisions provide that other companies are responsible for processing the individual data listed below or are jointly responsible with us. Therefore, in this case, the information from these suppliers is also decisive.
2. Contact person
If you have any questions about data protection or wish to exercise your rights in this respect, please contact our contact person by sending an e-mail to:
3. Your rights
Subject to compliance with legal requirements, you, as the data subject, have the following rights:
- Right to information: You have the right to request free access to your personal data stored by us at any time if we process it. This gives you the opportunity to check what personal data we are processing about you and to confirm that we are using it in accordance with the applicable data protection regulations.
- Right of rectification: You have the right to have inaccurate or incomplete personal data rectified and to be informed of the rectification. In this case, we will inform the recipients of the data concerned of the corrections made, unless this is impossible or involves a disproportionate effort.
- Right to erasure: You have the right to have your personal data erased in certain circumstances. In special cases, for example in the case of legal retention requirements, the right to erasure may be waived. In this case, if the conditions are met, the data may be blocked instead of deleted.
- Right to limit processing: You have the right to request that the processing of your personal data be limited.
- Right to data portability: You have the right to receive from us the personal data you have communicated to us, free of charge and in a readable format.
- Right to object: You may object at any time to the processing of your data, particularly in the context of direct marketing (e.g. advertising e-mails).
- Right of withdrawal: In principle, you have the right to withdraw your consent at any time. However, processing activities based on past consent will not become unlawful as a result of your withdrawal.
To exercise these rights, please send us an email to the following address:
Right of appeal: You have the right to lodge a complaint with a competent supervisory authority, for example against the way in which your personal data is processed.
4. Data security
We implement appropriate technical and organisational security measures to protect the personal data we store against loss and unlawful processing, i.e. unauthorised access by third parties. Our employees and service providers commissioned by us are bound by rules of confidentiality and data protection. In addition, these persons only have access to personal data to the extent necessary for the performance of their activities.
Our security measures are constantly adapted in line with technological developments. However, the transmission of information via the Internet and electronic means of communication always involves certain security risks, and we cannot guarantee the absolute security of information transmitted in this way.
5. Collection and processing of personal data
We primarily process personal data that we receive from our customers and other business partners as part of our business relationship with them and others involved in that relationship, or that we collect from their users as part of the operation of our website(s), applications and other programmes. Where permitted, we also collect certain data from publicly available sources (e.g. debt enforcement register, land register, commercial register, press and internet) or receive such data from public authorities and other third parties (such as credit agencies or address providers).
In addition to the data about you that you provide to us directly, the categories of data we receive from third parties include information from public registers, information that comes to our attention in the course of official and legal proceedings, information relating to your professional functions and activities (for example, to enable us to enter into and process transactions with your employer with your assistance), information about you in correspondence and meetings with third parties, credit assessments (to the extent that we transact with you personally), information about you provided by persons close to you (family, advisers, legal representatives, etc.) to enable us to conclude contracts or agreements with third parties or with you, respectively contracts or agreements concerning you (e.g. obtaining references), your address for deliveries, powers of attorney, information on compliance with legal requirements such as the fight against money laundering and export restrictions, information from banks, insurance companies (e.g. payments and purchases made), personal data from the media and the Internet (if appropriate in the specific case, e.g. in the context of a job application, press review, marketing/sales, etc.), your addresses and, if applicable, your contact details. ), your addresses and, where applicable, your interests and other socio-demographic data (for marketing purposes), data relating to the use of the website (e.g. IP address, MAC address of the smartphone or computer, information about your device and its settings, cookies, date and time of visit, pages consulted and content, functions used, referring website, location information).
6. Purpose of data processing and legal basis
We use the personal data we collect primarily to enter into and perform our commitments with our customers and partners, in particular in the context of our furniture sales activity.
As part of this activity, we collect personal data for transactions with our customers and the purchase of products and services from our partners and subcontractors, as well as to comply with our legal obligations in Switzerland and abroad. If you work for such a customer or partner, your personal data may of course also be affected in this capacity.
We also process your data and that of others, where permitted and deemed appropriate, for the following purposes in which we (and sometimes third parties) have a legitimate interest:
- To offer and develop our products, services and websites, applications and other platforms on which we are present;
- Communicate with third parties and deal with their requests (e.g. job applications, media enquiries);
- To test and optimise procedures for analysing customer needs, contacting customers and collecting personal data from publicly available sources for customer acquisition purposes;
- Advertising and marketing (including the organisation of events), unless you have objected to the use of your data (if we send you advertising as an existing customer, you may object at any time; we will then put you on a list blocking further advertising);
- Market and opinion research, media monitoring ;
- Asserting our rights and defending us in disputes and administrative or legal proceedings;
- Preventing and investigating criminal offences and other misconduct (e.g. conducting internal investigations, analysing data to combat fraud);
- Ensure the smooth running of our operations, in particular IT, our websites, apps and other platforms;
- Video surveillance to protect our property rights and other measures for the security of IT systems, buildings and installations and for the protection of our employees, other persons and property belonging to us or entrusted to us (such as access controls, visitor lists, network and mail scanning, telephone records);
- The purchase and sale of departments, companies or parts of companies and other transactions governed by company law and the corresponding transfer of personal data, as well as business management measures and, to the extent necessary, compliance with legal and regulatory obligations and our internal regulations.
7. Making contact
Any contact via our addresses and contact channels (e.g. e-mail, telephone or contact form) involves the processing of your personal data. We process the data you make available to us, e.g. the name of your company, your name, your job title, your e-mail address or telephone number and your question. The time of receipt of the request is also recorded. Mandatory information is marked with an asterisk (*) on contact forms.
We process this data exclusively for the purpose of fulfilling your request (e.g. providing product information, helping you to fulfil contracts such as returning products, providing feedback on improving our service, etc.).
8. Use of your data for marketing purposes
8.1 Central data storage and analysis in the CRM system
If it is clearly possible to link the data to your person, we will store and link the data referred to in this data protection policy, i.e. in particular your contact details, your contractual data and your browsing behaviour on our websites in a centralised database. This will enable us to manage customer data efficiently, to respond appropriately to your concerns, to provide you with the requested services efficiently and to perform the associated contracts.
We evaluate this data in order to develop our ranges according to your needs and to display and propose the most relevant information and offers possible. We also use methods that enable us to anticipate your possible interests and future orders based on your use of our website.
8.2 E-mail marketing and newsletters
If you subscribe to our newsletter by e-mail (e.g. when you register, in your customer account or when you place an order), the following data will be collected. Mandatory information is marked with an asterisk (*) on the registration form:
- E-mail address
- Title
- Full name
- Date of birth
By registering, you consent to the processing of this data in order to receive information about our company, our furniture offers and related products and services. You may also receive invitations to take part in prize draws or to evaluate one of the aforementioned products or services. Collecting the title and name enables us to check whether the registration corresponds to an existing customer account and to personalise the content of e-mails. The connection to the customer account helps us to make the offers and content of the newsletter more relevant to you and better adapted to your potential needs.
We use your data to send you e-mails until you withdraw your consent. You can withdraw your consent at any time, in particular via the unsubscribe link in all our marketing e-mails.
Our marketing e-mails may contain a web beacon, a 1x1 pixel (spy pixel) or similar technical aids. A web beacon is an invisible graphic file that is linked to the user ID of the subscriber to the newsletter concerned. For each marketing e-mail sent, we receive information on the addresses that have not yet received the e-mail, the addresses to which it was sent and the addresses to which it was unsuccessfully sent. We also see which addresses opened the e-mail, for how long and which links the recipients clicked on. Finally, we receive information on addresses that have unsubscribed. We use this data for statistical purposes and to optimise advertising emails in terms of frequency, timing, structure and content. This enables us to tailor the information and offers in our e-mails more closely to the individual interests of the recipients.
The web beacon is removed when you delete the e-mail. To prevent the use of the web beacon in our marketing emails, please set your email software to ensure that HTML code is not displayed in messages if it is not already displayed by default. Consult the support sections of your email software to find out how to configure this setting, e.g. here for Microsoft Outlook.
By subscribing to the newsletter, you also agree to the statistical evaluation of user behaviour in order to optimise and adapt this publication.
We use Mailchimp (US) & Klaviyo (US) email marketing software for email marketing. As a result, your data will be stored on a database owned by them, which will enable them to access your data as necessary for the provision of the software and for support in its use.
9. Disclosure to and access by third parties
Without the support of other companies, we would not be able to offer our services in the desired form. We must therefore disclose some of your personal data to these companies in order to be able to use their services. This communication takes place to the extent necessary to perform the contract you have requested. This includes, for example, communication to logistics or transport companies that deliver the desired products, or to manufacturers from whom you can make a warranty claim.
Data is also passed on to selected service providers only to the extent necessary to provide the service. In addition, various third-party service providers are explicitly referred to in this data protection policy, for example in the sections relating to marketing. These include IT service providers (e.g. software solution providers), advertising agencies and consultancies.
In addition, your data may be shared, in particular with authorities, legal advisors or collection agencies, if we are legally obliged to do so or if it is necessary to protect our rights, in particular to enforce rights arising from our relationship with you. Data may also be shared if another company intends to acquire all or part of our business and such sharing is necessary to carry out due diligence checks or to complete the transaction.
10. Cross-border communication of data
We also reserve the right to communicate your personal data to third parties located abroad if this is necessary to carry out the data processing provided for in this data protection policy (see in particular points 12 to 15). Naturally, the legal provisions relating to the communication of personal data to third parties will be complied with. If the country in question does not have an adequate level of data protection, we ensure, by entering into contractual arrangements with these companies, that your data is adequately protected.
11. Retention periods
We only retain personal data for the period necessary to carry out the processing described in this data protection policy and based on our legitimate interest. As far as contractual data is concerned, registration is covered by legal retention requirements. The rules that oblige us to retain data result from accounting and tax regulations. According to these regulations, commercial communications, contracts concluded and accounting documents must be kept for a period of 10 years. If we no longer need this data to perform the services on your behalf, the data will be blocked. This means that the data may only be used if necessary to meet our retention obligations or to defend and enforce our legal interests. The data will be deleted as soon as there is no longer any obligation to retain it or any legitimate interest in doing so.
A. Special provisions relating to our website
12. Log data
When you visit our website, the servers of our hosting provider (Sonassi Ltd, UK) and our CDN (Cloudflare, US) temporarily store each access in a log file (referred to as a 'log file'). The following data is recorded without your intervention and stored by us until it is automatically deleted:
- the IP address of the requesting computer,
- the date and time of access,
- the name and URL of the file consulted,
- the website from which it was accessed, possibly with the search term used,
- your computer's operating system and the browser you use (including type, version and language settings),
- the type of device in the case of mobile phone access,
- the city or region from which access was gained,
- the name of your Internet Service Provider.
This data is collected and processed for the purpose of enabling use of our website (establishing a connection), ensuring long-term system security and stability, analysing errors and performance, and enabling us to optimise our website (see also the last elements of point 13).
In the event of an attack on the website's network infrastructure or in the event of suspicion of unauthorised or abusive use of the website, the IP address and other data will be evaluated for the purposes of explanation and defence and, if necessary, as part of legal proceedings for the purposes of identification and as part of civil and criminal proceedings brought against the users concerned.
Finally, we use cookies as well as applications and tools based on the use of cookies when you visit our website. In this context, the data described herein may also be processed. You will find more detailed information on this subject in the following sections of this data protection policy, in particular point 11.
13. Cookies
Cookies are information files that your web browser stores on your computer's hard disk or memory when you visit our website. Cookies are associated with identification numbers that enable your browser to be recognised and the information contained in the cookie to be read.
Cookies help, among other things, to make your visit to our website easier, more pleasant and more relevant. We use cookies for various purposes that are necessary for the use you wish to make of our website, i.e. that are 'technically necessary'. For example, we use cookies that allow us to identify you as a registered user after you have logged in without you having to log in again when you navigate between different sub-pages. The shopping basket and order functions also rely on the use of cookies. Cookies also perform other technical functions necessary for the website to function, such as so-called 'load balancing', i.e. distributing the site's performance load over different web servers in order to relieve the servers. Cookies are also used for security purposes, for example to prevent unauthorised publication of certain content. Finally, we use cookies as part of the design and programming of our website, for example to enable scripts or codes to be downloaded.
Most Internet browsers automatically accept cookies. Users have the option of deactivating them via their browser's security settings. If they do not do so, they consent to the collection and processing of the data collected.
The following pages explain how you can configure the way cookies are handled by the browsers in question.
- Google Chrome: https://support.google.com/chrome/answer/95647?hl=fr
- Apple Safari: https://support.apple.com/fr-ch/guide/safari/sfri11471/mac
Deactivating cookies may hinder your use of certain functions on our website.
15. Tracking and web analysis tools
15.1 General information on tracking
We use the web analysis services listed below to design a website that meets your needs and to optimise it on an ongoing basis. In this context, pseudonymised user profiles are created and cookies are used (please also note point 11). The information generated by the cookie about your use of this website is generally transferred to a server of the service provider, where it is stored and processed together with the log file data listed in point 10. The information may also be transferred to servers located abroad, e.g. in the United States (see point 8, in particular on the guarantees provided).
When we process data, we receive the following information, among others:
- the navigation path that a visitor has followed on our site (including the content consulted and the products selected or purchased),
- duration of the visit to the site or sub-page,
- sub-page on which the website is located,
- country, region or city from which access is gained,
- end device (type, version, colour depth, resolution, width and height of the browser window) and
- recurring or new visitor.
The supplier will use this information to evaluate the use of the website, to compile reports on website activity on our behalf and to provide other services related to website activity and internet usage for market research and needs-based site design purposes. In relation to this processing, we and the suppliers may be considered to some extent as joint data controllers under applicable data protection legislation.
You may withdraw your consent or refuse processing at any time by refusing or deactivating the cookies concerned in the settings of your web browser (see point 11) or by using the options specific to the services described below.
For further processing of the data by the relevant supplier as (sole) responsible under the applicable data protection legislation, in particular the possible transfer of such information to third parties such as authorities under national legislation, please consult the respective data protection information of the supplier.
15.2 Google Analytics
We use the Google Analytics web analysis service provided by Google Ireland Limited (Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland) or Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, United States) ('Google').
The aforementioned data relating to the use of the website for the aforementioned purposes (see point 13.1) may be transmitted to Google LLC servers in the United States. By activating the IP anonymization function ('anonymizeIP') on this website, the IP address can be shortened prior to transmission to the Member States of the European Union or to other States party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there.
Users can prevent the data generated by the cookie and linked to the use of the website (including the IP address) from being sent to and processed by Google by downloading and installing a browser plug-in at the following link:
https://tools.google.com/dlpage/gaoptout?hl=fr. Click here for more information on data protection at Google.
16. Social media
16.1 Social media profiles
We have included links to our social media profiles on our website.
If you click on the social media icons, you will automatically be redirected to our respective profile. A direct connection is established between your browser and the server of the respective social network. This informs the media that you have visited our website from your IP address and clicked on the link.
If you click on a link to a medium while you are logged in to your user account on that network, the content of our website may be linked to your profile to enable the medium to attribute your visit to our website directly to your account. If you wish to avoid this, you must disconnect before clicking on the corresponding links. There is always a link between your access to our website and your user account when you connect to the network in question after clicking on the link. The respective provider is responsible under the applicable data protection legislation for processing the associated data. Please therefore note the information on the network's website.
16.2 Social media plug-ins
We use social media plug-ins to make it easier for you to share content from our website. Social media plug-ins help us to increase the visibility of our content on social networks and, in this respect, to improve our marketing operations.
The content of the plug-in is transmitted directly from the social network to your browser, which integrates it into the website. This makes it possible to inform the supplier concerned that your browser has accessed the corresponding page on our website even if you do not have an account for this social network or are not currently connected to it. This information (including your IP address) is transmitted directly from your browser to the provider's server (usually in the USA) and stored there. We have no influence over the extent of the data that the provider collects using the plug-in, even though, from the point of view of the applicable data protection legislation, we may be considered to be co-responsible with the providers up to a certain point.
If you are connected to a social network, the latter may attribute your visit to our website directly to your user account. If you interact with the plug-ins, the corresponding information is sent directly to the supplier's server for storage. The information (e.g. the fact that you like one of our products) may also be published on the social network and displayed to other users of the medium in question. The social network provider may use this information to place advertisements and to tailor the relevant offer to your needs. To this end, profiles of use, centres of interest and relationships may be created, for example to evaluate your use of our website with regard to advertising presented to you on the social network, to inform other users of the activities you carry out on our website and to provide other services linked to the use of the social network. The purpose and scope of the data collection and the subsequent processing and use of the data by the social network providers, as well as your rights in this respect and the options for setting your privacy settings, can be consulted directly in the data protection information of the provider concerned.
If you do not want the social network provider to allocate the data collected via our website to your user account, you must log out of the social network before activating the plug-in. You can withdraw your consent at any time by declaring your wish to withdraw it to the plug-in provider in accordance with the information contained in its data protection declaration.
17. Online advertising and targeting
17.1 General provisions
We use the services of various companies to provide you with interesting online offers. We analyse your user behaviour on our website and on the websites of other providers in order to offer you online advertising tailored to your individual needs.
Most of the technologies used to track your user behaviour and display targeted advertising use cookies (see also point 11) to recognise your browser on different websites. Depending on the service provider you use, you may also be recognised online even when you use different terminals (e.g. laptop and smartphone). This may be the case, for example, if you register for a service that you use with several devices.
In addition to the data already mentioned, which is generated when you visit websites ('log data', point 10) and when you use cookies (point 11) and which may refer to companies belonging to advertising networks, the following data, in particular, helps to select advertisements likely to be of interest to you:
- Information about you that you have given us when registering or using an advertising partner's service (e.g. your gender, age group);
- User behaviour information (e.g. search terms, interactions with advertisements, types of websites visited, products viewed and purchased, newsletters subscribed to).
We and our service providers use this data to determine whether you belong to the target group we are targeting and take this into account when selecting the advertisements to be displayed. For example, when you visit certain sites after visiting ours, you may be offered advertisements relating to the products you have consulted ('re-targeting'). Depending on the scope of the data, a user profile may also be created and evaluated automatically. Advertisements are then selected on the basis of information stored in the profile, such as membership of specific demographic segments or potential centres of interest or behaviour. These advertisements may be presented to you on different channels which, in addition to our website or application (as part of on-site and in-app marketing), also include advertisements delivered via online advertising networks that we use, such as Google.
The data may then be evaluated for billing purposes with the service provider and to assess the effectiveness of advertising measures in order to better understand the needs of our users and customers and to improve subsequent campaigns. It may also include information indicating that an action (e.g. going to certain sections of our website or sending information) is the result of a specific advertisement. We also receive from service providers aggregate reports on advertising activity and information about how users interact with our website and advertisements.
You can withdraw your consent at any time by refusing or deactivating the cookies concerned in the settings of your web browser (see point 11). Other methods of blocking advertising are also offered in the information provided by the respective service provider, e.g. Google.
17.2 Google Ads
This website uses the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ('Google') for online advertising. To this end, Google uses cookies, such as 'DoubleClick' cookies, which recognise your browser when you visit other websites. The information generated by the cookie about your visit to this website (including your IP address) will be transmitted to and stored by Google on servers in the United States (see also section 8). Click here for more information on Google's data protection policy.
You can withdraw your consent at any time by refusing or deactivating the cookies concerned in the settings of your web browser (see point 11). Other ways of blocking advertising can be found here.
18. Use of our chat function
If you contact us by chat, your personal data will be processed. We will process the data made available to us in this way, e.g. the name of your company, your name, your job title, your e-mail address and your question. The time of receipt of the enquiry is also recorded. Mandatory information is marked with an asterisk (*).
We process this data exclusively for the purpose of fulfilling your request (e.g. providing product information, helping to fulfil contracts such as product returns, providing feedback on improving our service, etc.). We use a tool from tawk.to inc (US) to provide you with the chat function. As a result, your data will be stored in a tawk.to inc. database which will allow tawk.to inc. to access your data as necessary to provide the software and support offered through its use.
19. Opening a customer account
If you open a customer account on our website, we will collect the following data, mandatory information being indicated by an asterisk (*) in the relevant form:
- Main data:
- Title
- Last name
- First name
- Invoice and delivery address
- Birthday
- Company, company address and EID number of client companies
- Connection details:
- E-mail address
- Password
- Other information:
- Languages
We use personal data to determine your identity and to check that the conditions for opening an account have been met. The e-mail address and password together serve as your login details and thus ensure that the right person is using the website under your login details. We also need your e-mail address to verify and confirm the opening of the account and for any future communication with you in connection with the performance of the contract. In addition, this data is stored in the customer account for future contract conclusion. For this purpose, we also allow you to store other account information (e.g. your preferred method of payment).
We also use the data to provide an overview of the products ordered and services purchased (see in particular points 18 and 23) and to offer a simple option for managing your personal data and for the purposes of managing our website and contractual relations, i.e. for the conclusion, content design, performance and modification of contracts concluded with you via your customer account.
We process language information for the purpose of providing you with offers on the website that are tailored to your profile or personal needs, for statistical recording and evaluation of selected offers and for optimising our suggestions and offers.
To avoid any misuse, you must always treat your connection data confidentially and close the browser window when you have finished communicating with us, especially if you share your computer with other people.
20. Ordering products
If you order products or book services on our website, we will need various data to process your request. If you do not log in with your customer account (see point 17), we will collect the following data (depending on the product or service), mandatory information being marked with an asterisk (*) in the relevant form:
- Title
- Name
- First name
- Invoice and delivery address
- E-mail address
- Anniversary date
- Company, company address and EID number of client companies
- Telephone number
We will use the data to determine your identity before entering into a contract. We will also need your e-mail address to confirm your order and for any future communication with you in connection with the performance of the contract. We will store your data together with ancillary order data (e.g. date, order number, etc.), data about the services ordered/booked (e.g. product description, price and features; the 'Product Data'), payment data (e.g. payment method selected, confirmation of payment, etc.) and other data ('Payment Data'), payment method selected, payment confirmation and date; see also point 19) as well as information necessary for the processing and fulfilment of the contract (e.g. return of products, use of services or guarantees, etc.) in our CRM database (see point 6.1) to ensure the correct processing of orders and fulfilment of the contract.
Insofar as this is necessary for the performance of the contract, we also pass on the information required to any third-party service providers (e.g. transport companies).
Data that is not marked as mandatory is provided on a voluntary basis. We process this data in order to adapt our offer to your personal needs, to facilitate the performance of contracts, to contact you via an alternative communication channel if necessary for the performance of the contract or to record and evaluate statistics in order to optimise our offers.
21. Processing online payments
If you purchase services or products from our website by payment, you will need to provide us with further data in addition to the information mentioned in point 18 depending on the products or services in question and the payment method you wish to use, for example your credit card details or the identifier you use to log in to your payment service provider. This information and the fact that you have purchased a product or service from us for the relevant amount and duration is passed on to the relevant payment service provider (e.g. payment solution providers, credit card issuers and credit card acquirers). Always consult the information provided by the company concerned, in particular the data protection policy and general terms and conditions.
In order to avoid payment problems, the required data, in particular your personal data, may also be communicated to a credit agency for automatic verification of your creditworthiness. For this purpose, the credit agency may give you a score. This is an estimate of the future risk of default, expressed for example as a percentage. The score is determined using mathematical and statistical methods and includes credit agency data from other sources. We reserve the right, depending on the information received, not to offer you the 'invoice' payment method.
22. Ratings and comments
In order to help other users in their purchasing decisions and to promote quality (in particular by dealing with negative comments), you have the opportunity to rate the products ordered on our website. The data you make available to us will be processed and published on the website, i.e. in addition to your rating and its time, possibly together with the comment you attached to your rating or the name you provided.
B. Specific information about our business premises
23. Use of our Wi-Fi network
On our business premises, you may use the Wi-Fi network free of charge. In doing so, you will transmit the following data to us:
- mobile phone number
- terminal MAC address (automatic)
In addition to the above data, data on the business premises visited is recorded along with the time, date and terminal each time the WiFi network is used.
Batiplus SA is required to comply with its legal obligations under the Federal Law on the Surveillance of Postal and Telecommunications Traffic and the associated ordinance. If the legal requirements are met, the Wi-Fi network operator must monitor Internet use and data traffic on behalf of the competent authority. The Wi-Fi network operator may also be required to disclose the customer's contact, usage and ancillary data to the relevant authorities. Contact, usage and auxiliary data will be kept for 6 months before being deleted.
24. Opening a customer account
If you open a customer account on our business premises, we collect the following data, with mandatory information indicated by an asterisk (*) on the relevant form:
- Title
- Name
- First name
- Invoice and delivery address
- E-mail address
- Company, company address and EID number of client companies
- Telephone number
We use the data to determine your identity and check that the opening conditions have been met. We collect your e-mail address and telephone number for any further communication required to fulfil the contract. In addition, this data, together with data relating to the purchase of products and services (see point 18), is stored under a customer number in the customer account in order to provide you with an overview of your data if you so wish and to enable a link to be made with data from other channels in the future. In addition, your account and the data stored are linked to your online account (see point 17) if the personal data is identical.
25. Buying or ordering products on our business premises
On our business premises, you can generally buy products without giving your name. In this case, please refer to the section on making payments (see point 25). On request, you will receive a paper statement, which you must keep and show in order to use the after-sales service (see point 26). However, you can also purchase products by providing your customer account. In this case, please also see the section on opening a customer account (see point 23).
When you purchase or order certain products, we need your name and other details in order to fulfil the contract. Depending on the product or service, we collect the following data, with mandatory information marked with an asterisk (*):
- Title
- Name
- First name
- Invoice and delivery address
- E-mail address
- Company, company address and EID number of client companies
- Phone number
We will use the data to determine your identity before entering into a contract. We also need your e-mail address for any further communication with you in connection with the performance of the contract. We will store your data together with ancillary order data (e.g. date, order number, etc.), data on the services ordered/booked (e.g. product description, price and features; the 'product data'), payment data (e.g. payment method selected, payment confirmation and payment details) and other data, payment method selected, payment confirmation and date; see also point 19) as well as information necessary for the processing and fulfilment of the contract (e.g. return of products, use of services or guarantees, etc.) in our CRM database (see point 6.1) to ensure the correct processing of orders and fulfilment of the contract.
Insofar as this is necessary for the performance of the contract, we also pass on the information required to any third-party service providers (e.g. transport companies).
The provision of data that is not marked as compulsory is voluntary. We process this data in order to adapt our offer to your personal needs, to facilitate the performance of contracts, to contact you via an alternative communication channel if necessary for the performance of the contract or to record and evaluate statistics in order to optimise our offers.
26. Execution of payments
The processing of personal data is necessary in the event of the purchase of products on our business premises using electronic means of payment. By using the payment terminals, you transmit the information stored in your means of payment, such as the cardholder's name and card number, to the relevant payment service providers (e.g. payment solution providers, credit card issuers and credit card acquirers). These service providers also receive the information that the means of payment was used on our business premises, as well as the amount and time of the transaction. For our part, we only receive the amount paid at the appropriate time, which we can attribute to the document number concerned or to the information that the transaction was not possible or was cancelled. Always consult the information provided by the company concerned, in particular the data protection policy and the general terms and conditions.
27. Use of customer services on business premises
On our business premises, you benefit from a number of customer services which may require the processing of personal data. This includes, for example, the collection of an ordered product, the return of products to exercise a right of return or warranty claim, service complaints, etc. In these situations, we collect the following data (depending on the product concerned or the service requested). Mandatory information on the forms is indicated by an asterisk (*):
- Title
- Name
- First name
- Invoice and delivery address
- E-mail address
- Company, company address and EID number of client companies
- Phone number
We use the data for identity verification purposes. We also need your e-mail address to communicate with you in order to provide you with a customer service. We store this data together with the information, time and content of the requested service in our CRM database (see point 6.1) to ensure that the requested service is carried out correctly. Insofar as this is necessary for the performance of the contract, we will also pass on the required information to third-party service providers (e.g. transport companies) or other relevant third parties (e.g. manufacturers, in the event of invocation of the manufacturer's warranty).
Batiplus application
The Batiplus application is used to obtain prices and information about our products in our showroom. The only personal data it collects is debugging information in the event of the application crashing, which is sent to us anonymously in order to detect and resolve problems encountered when using the application. This data is completely anonymous and is only used for diagnostic purposes.
